RULES OF THE ONLINE VOTING "PUBLIC CHOICE AWARD”

Fondation RAJA Women's Awards 2023 Ceremony

Article 1

ONLINE VOTING ORGANIZER

The Fondation RAJA-Danièle Marcovici, a foundation under the aegis of the Fondation de France, whose head office is located at 16 rue de l'Etang - Paris Nord 2 - 95 977 Roissy Charles de Gaulle Cedex ("the Organizer"), is organizing from Tuesday, October 10 to Tuesday, October 31, 2023 at midnight, French time, a free online vote with no obligation to purchase under the conditions set out in these rules. This vote is part of the RAJA-Danièle Marcovici Foundation's RAJA Women's Awards 2023 ceremony and is intended to reward one of the 7 nominated associations for its commitment to women.

Article 2

TERMS OF PARTICIPATION

This online vote will be accessible exclusively via the Internet at the following URL address: www.prixdupublic.fondation-raja-marcovici.com. The vote is open to any individual with Internet access and a valid e-mail address. Only one vote is possible per e-mail address. The Organizer reserves the right to cancel one or more votes of a person if he/she participates or attempts to participate in the online vote in a fraudulent manner. Participation in the vote implies full acceptance of the present rules in their entirety.

Article 3

TECHNIQUES USED TO PREVENT FRAUD

At the time of registration, the participant certifies that the data entered is accurate and complete. Any false or erroneous declaration will automatically lead to the cancellation of the vote. Proven intent or attempt to cheat by a participant, in particular by creating false identities enabling multiple votes, may be penalized by a formal and definitive ban on voting. The organizing team reserves the right to delete votes from suspicious IP addresses without being held accountable.

Article 4

RESULTAT

At the end of the voting, on Tuesday October 31, 2023 at midnight, French time, the number of votes will be counted by the RAJA-Danièle Marcovici Foundation. The association with the highest number of votes will be awarded the Public Prize. The winner of the People's Choice Award will be announced on the day of the ceremony, Tuesday November 14, 2023, and the result will be made public the week of November 20, 2023 on www.prixdupublic.fondation-raja-marcovici.com. Candidate associations will not have access to the results before the ceremony. A counter on www.prixdupublic.fondation-raja-marcovici.com will keep track of the results, and will be updated throughout the voting period. However, in order to maintain the element of surprise as the results approach, this counter will no longer be visible from October 28, 2023.

In accordance with the operating rules of the Fondation de France, the decision to award the People's Choice Award can only be finalized after validation by the Executive Committee of the Fondation RAJA-Danièle Marcovici.

Article 5

DEFINITION AND VALUE OF THE PRIZE

The People's Choice Award will be presented to the association with the most online votes on Tuesday, October 31, 2023 at midnight, French time. The winning association will be notified by the RAJA- Danièle Marcovici Foundation one week before the Ceremony. An endowment of €15,000 will be paid by bank transfer within three months. The association will also receive a trophy and will be invited to receive it on stage at the Ceremony to be held in Paris (Théâtre du Trianon) on November 14, 2023. In the event of a tie between several associations at the end of the voting, this prize will be shared equally between the associations elected.

Article 6

INTERPRETATION OF THE RULES

Participation in this game implies full acceptance of the terms and conditions set out in these rules by the voters and by the candidate associations. The Fondation RAJA - Danièle Marcovici team will answer all questions concerning the practicalities of voting throughout the duration of the competition.

Article 7

PROTECTION OF PERSONAL DATA

Participation in the vote implies acceptance of the rules. Information concerning participants is intended for Fondation RAJA-Danièle Marcovici. Participants' contact details (surname, first name and e-mail address) will be collected and processed by the Organizer for the sole purpose of managing and recording votes in the context of the "Public's Favourite Prize" game of the RAJA-Danièle Marcovici Foundation's RAJA Women's Awards 2023 ceremony. In accordance with the General Data Protection Regulation ("RGPD") and the amended Act of January 6, 1978 on Data Processing, Data Files and Individual Liberties, Participants have the right to access, rectify, delete and object to information concerning them. This right may be exercised by contacting the Organizer by e-mail at the following address: fondation@raja.fr or by writing to the postal address: Fondation RAJA-Danièle Marcovici, 16 rue de l'Etang, Paris Nord 2, 95 977 Roissy Charles de Gaulle Cedex.

Article 8

LIMITATIONS ON INTERNET USE

You are expressly reminded that the Internet is not a secure network. Participation in the vote implies knowledge and acceptance of the characteristics and limits of the Internet network. The Organizer cannot therefore be held responsible for contamination by any viruses or for the intrusion of a third party into the system of the terminal of participants in the game and declines all responsibility for the consequences of the connection of participants to the network via the site. The Organizer may not be held liable in the event of Internet network malfunctions, due in particular to external malicious acts, which would prevent the voting process from running smoothly and participants from being informed. In particular, those who, by any means whatsoever, attempt to modify the proposed voting mechanisms, in particular in order to alter the results, will be excluded.

The Fondation RAJA-Danièle Marcovici reserves the right to cancel, terminate or modify this operation if it is not carried out as agreed: any virus, bug, violation, unauthorized intervention, fraud, action by a competitor, technical problem or other cause beyond the control of the Fondation RAJA-Danièle Marcovici. The organizers shall not be held liable in the event that one or more participants are unable to connect to the voting site or to participate due to any problem or technical fault related to the site's servers or hosts.

Article 9

MODIFICATION OF THE RULES/LIMITATION OF LIABILITY

The Organizer reserves the right to modify the present rules at any time and to make any decisions it may deem useful for the application of the rules. The Organizer may inform participants by any means of its choice.

The Fondation RAJA-Danièle Marcovici shall not be held liable in any way whatsoever if, in the event of force majeure or events beyond its control or justified necessity, it is forced to cancel, shorten, extend, postpone or modify the conditions of this game, without participants being entitled to claim any compensation.

Article 10

NEWSLETTER

Participants may subscribe to the newsletter of the Fondation RAJA-Danièle Marcovici if they wish, and this subscription is subject to the participant's agreement to the processing of the data he/she has provided. The data provided will be processed electronically to enable the RAJA-Danièle Marcovici Foundation to send regular information about the RAJA-Danièle Marcovici Foundation to the e-mail address provided. This information will not be sold or transferred to third parties in any way whatsoever.

CONSULTING THE RULES

Le règlement est consultable à tout moment sur le site internet  en français. The rules may be consulted at any time on the website www.prixdupublic.fondation-raja-marcovici.com in French.

Article 12

APPLICABLE LAW - DISPUTES

The present rules are subject to French law.

To be taken into account, any complaints relating to the vote must be made in writing to the address indicated in article 7 above, and no later than thirty (30) days after the closing date for participation in the vote as indicated in these rules.

In the event of persistent disagreement on the application or interpretation of the present rules, and failing amicable agreement, any dispute will be submitted to the competent court, according to the legal rules of territorial jurisdiction or attribution.
